These Terms of Service (“Terms”) apply to your use of the website abilitymic.com and the AbilityMic application (“App”) provided by Kierepka.pl (“we”, “us”, “our”). By using the website or the App, you agree to these Terms. If you do not agree, do not use the website or the App.

1. Use of the Website

The website is for information only. You may use it for lawful purposes. You may not use it to harm others, violate laws, or attempt to gain unauthorised access to our or third-party systems. We do not guarantee uninterrupted or error-free access.

2. Use of the Application

The App is a consumer AAC (Augmentative and Alternative Communication) tool, not a medical device or clinical record system. It does not diagnose, treat, monitor health conditions, recommend therapy, or make clinical decisions. Usage statistics are descriptive only. We do not provide medical, legal, or therapeutic advice. The App is provided “as is” to the extent permitted by law.

3. AI Features

Some features of the App use artificial intelligence. They are optional, disabled by default, and can be switched off at any time. What each one does, what it sends and what it never does is described in our AI transparency notice.

• Suggestions are proposals. Sentences, symbols and board drafts produced by AI are generated automatically, may be inaccurate, incomplete or unsuitable, and are always presented for a person to accept, edit or discard. You decide what is spoken, sent or saved, and you are responsible for that choice.
• Not advice. AI output is not medical, therapeutic, legal or emergency advice and must not be relied on as such. Emergency SOS does not use AI.
• Supervision. Where the App is used by a child or by someone who cannot independently evaluate a suggestion, the parent, guardian or AAC professional decides which AI features to enable and supervises their use.
• Acceptable use. You may not use the AI features to create unlawful, harassing or deceptive content, to impersonate another person, or to extract, copy, reverse-engineer or retrain the underlying models.
• Availability. On-device AI depends on your hardware, operating system and language; online AI depends on connectivity and on third-party providers. We may change or withdraw an AI feature. Core AAC communication does not depend on AI and keeps working without it.
• Output. As between you and us, you may use the content the App generates for you. Comparable requests may produce similar output for other users, and we make no claim that generated output is unique.

4. Intellectual Property

AbilityMic, the website, and the App (including design, text, and software) are owned or licensed by us. You may not copy, modify, or distribute our content or software except as allowed by the App’s licence or with our written permission. You retain rights to content you create in the App (e.g. boards); you grant us only the rights necessary to operate the App.

5. Privacy

Your use of the website and the App is also governed by our Privacy Policy, which complies with applicable data protection laws (including GDPR and CCPA). By using the website or the App, you acknowledge that you have read the Privacy Policy.

6. Limitation of Liability

To the fullest extent permitted by applicable law:

• We are not liable for indirect, incidental, special, or consequential damages arising from your use of the website or the App.
• Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or, if nothing was paid, zero).

Some jurisdictions do not allow certain limitations; in such cases, our liability is limited to the maximum extent permitted by law.

7. Changes

We may change these Terms. The “Last Updated” date will change. Continued use of the website or the App after changes constitutes acceptance. Material changes may be communicated via the App or on this page.

8. Governing Law and Disputes

These Terms are governed by the laws of Poland. Any dispute shall be subject to the courts of Poland, unless mandatory consumer law in your country requires otherwise.
